Delivery Drivers Sue DHL for Unpaid Overtime

Third-party delivery drivers for DHL have filed a class action lawsuit for unpaid overtime. In order to increase delivery volume, DHL has contracted smaller third-party delivery services, but DHL has failed to properly ensure that these workers get paid overtime wages. What Does the Complaint Allege?

The DHL eCommerce program was created in order to expand the company’s delivery capacity. Under this program, DHL enlists the services of smaller delivery firms, which have their employees deliver packages on behalf of DHL. Importantly, the third-party drivers are given DHL branded trucks and uniforms.

The cases allege that many of these third-party employers have failed to adequately pay their workers for their time and that DHL is responsible for their underpaid wages. The companies allegedly violated state and federal wage and hour laws by not paying their workers their full overtime compensation and by requiring employees to work unpaid during breaks.

Are Delivery Drivers Entitled to Overtime Pay?

Under the federal Fair Labor Standards Act (“FLSA”), workers are entitled to one-and-a-half times their usual hourly rate for all time over 40 hours a week. Many of these smaller vendors allegedly failed to meet these standards. Also, some of these companies forced their employees to work off-the-clock before and after their shifts.

While these drivers were hired by third parties, DHL had control over how these workers were compensated. DHL should have taken the necessary steps to ensure that the drivers were paid fully for all hours worked.
